Terms of Service
EFFECTIVE DATE: JULY 16, 2026
WHAT CHANGED (JULY 16, 2026): Section 5 clarifies the content license is for serving you, never for training; Section 6 describes edit-decisions sharing and the Training Circle as two live, separate programs, and states the Studio/enterprise process-capture exclusion; Section 4 corrects the authentication provider to Better Auth (Google/Facebook sign-in).
These Terms of Service ("Terms") govern your use of Real Cut ("Service"), available at realcut.ai and operated by NotBW d.o.o., a company registered in Slovenia ("Company", "we", "our", "us").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About the Service
Real Cut is an automated video editing service. You upload raw footage and the Service returns an edited cut. Editing decisions are made by RCM 1, our own editing model. You can request changes to a cut in plain language, and the Service produces revised versions.
RCM 1 edits the footage you provide. It does not generate synthetic video, voices, or faces.
2. Early Access
The Service is in early access. RCM 1 is in active training, and its output improves over time. This has practical consequences you accept by using the Service:
- We do not guarantee that any cut meets a particular standard of quality or is fit for a particular purpose
- Refinements are included: if a cut is not right, you can request changes as part of your plan
- Features, limits, and processing times may change as the Service develops
You are responsible for reviewing every cut before you publish or otherwise use it.
3. Eligibility
You must be at least 16 years old to use the Service.
If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
4. Accounts
You need an account to use the Service. Authentication is handled by Better Auth, our own first-party authentication system; you sign in with Google or Facebook, and we never see or store your password.
You agree to:
- Provide accurate account information
- Keep your login credentials secure
- Notify us of unauthorized access to your account
We may suspend or terminate accounts that violate these Terms.
5. Your Content and Your Output
"Your Content" includes:
- Videos, audio, images, documents, and scripts you upload
- Files you import from Google Drive
- Editing instructions and notes you provide
You keep all rights to your footage and to the edited output.
We claim no ownership of your footage or of the cuts the Service produces from it. You may use the edited output for any lawful purpose, commercial or personal, with no attribution required.
You grant us a limited, revocable license to store, process, edit, and deliver Your Content for the sole purpose of providing the Service to you. This license ends when you delete the content or your account, subject to the retention periods in our Privacy Policy.
This license is for serving you, not for training. Nothing in this section — and nothing anywhere else in these Terms — gives us any right to use Your Content to train RCM 1 or any other model. Training happens only under the separate, explicit programs described in Section 6, each recorded with its own consent, each revocable. We take no perpetual rights, no sublicense rights, and no rights to anyone’s name, face, voice, or likeness.
You are responsible for Your Content. You represent that you have the rights needed to upload it and to have it edited.
6. RCM 1 and Model Training
Your footage is never used to train RCM 1 — under any plan, ever.
RCM 1 is trained on our own edits, paid narrated editing sessions, licensed footage, and data customers explicitly choose to share. We will never generate videos from your footage, and we will never clone you — not your face, not your voice, not your likeness. What customers can share are perception signals connected to reasoning and decision-making during editing — what was looked at, what was marked, what changed, in what order, and why — never the footage itself.
Edit-decisions sharing is an explicit choice: new accounts choose at sign-up, with no preselected answer, and every personal account can change the choice at any time in Settings → Data. Declining costs nothing — the product is identical either way. Sharing is never retroactive and never includes your footage or your audio.
The Training Circle is the only program under which footage trains RCM 1. It is per-project, opt-in, separately consented with its own recorded text — never part of accepting these Terms. Enrollment includes confirming you have the rights to share the footage and that people appearing in it are okay with that; nothing with minors.
Studio and enterprise accounts: we don’t train on any of your data, full stop. API and MCP usage is never used for training unless your organization explicitly opts in; that option is not offered to business plans.
The editing process.Our own editors — the founder, paid Real Cut editors, and friend-of-the-founder testers — work under separate, explicit agreements that make their editing sessions, including narration when the microphone is on, training data. When such an editor works on a personal account’s footage that is not itself eligible for training, we may use the editing process and the editor’s narration — not your footage — to improve our model: the decisions, the commentary, and the timecodes, with your footage and every proxy of it stripped from the record before any training use. You can decline even this in Settings → Data. This never occurs on Studio or enterprise footage.
Our Privacy Policy describes this commitment in full, including what limited technical data we do use to operate and improve the Service.
7. Google Drive Access
If you choose to connect Google Drive, you grant us permission to:
- Display files and metadata inside folders you select
- Allow you to choose which files to import
- Download only the selected files
- Transfer those files securely to our storage for editing
We do not:
- Access folders you did not select
- Modify, delete, or create files in your Drive
- Store your Google credentials
- Use Drive files for analytics, advertising, or model training

8. Subscriptions, Credits, and Payment
8.1 Plans and credits
The Service is sold as a subscription. Each plan includes a monthly allowance of credits, which meter how much footage you can have edited. Current plans, prices, credit amounts, and any free tier are listed on the pricing page, which forms part of these Terms.
Credits included with a subscription reset each billing period unless the pricing page states otherwise. Additional credits purchased as top-ups remain available as described at the time of purchase.
8.2 Billing
Payments are processed by Stripe. We do not store your card details. Subscriptions renew automatically at the end of each billing period until cancelled.
8.3 Cancellation and refunds
You can manage your subscription, change plans, update payment details, and cancel at any time through the Stripe customer portal, available from your account. Cancellation takes effect at the end of the current billing period; you keep access until then.
If a charge was made in error, or the Service failed to produce anything for a charge, contact us at zan@realcut.ai and we will correct it with a credit or a refund.
Nothing in these Terms limits refund rights you hold under the mandatory consumer law of your country of residence.
8.4 Failed payments and chargebacks
If a subscription payment fails, Stripe retries the charge automatically and we notify you by email. Your plan stays available during the retry window. If payment cannot be collected, the subscription ends and the account returns to the free tier.
When a payment is refunded or reversed, the credits and any storage allowance that payment provided are removed, whether or not they have been spent. If you dispute a charge with your bank (a chargeback), the subscription paid for by the disputed charge is suspended while the dispute is open. If the dispute resolves in your favor, access and the removed credits are restored. Contacting us first at zan@realcut.ai is faster than a chargeback for correcting a billing error.
9. Prohibited Content and Use
You may not upload, or ask the Service to edit:
- Content that is illegal in your jurisdiction or in Slovenia
- Any sexual content involving minors
- Content that infringes someone else's copyright, trademark, or privacy rights
- Content depicting or promoting violence against identifiable people, or intended to harass, defame, or deceive
- Malware or files designed to damage systems
You also may not:
- Interfere with the Service or its security systems
- Scrape the Service or access it by automated means outside the interfaces we provide
- Reverse-engineer the Service or attempt to extract RCM 1 or its weights
- Resell access to the Service without our written agreement
We may remove content and refuse or suspend service to enforce this section.
10. Intellectual Property
The Service itself — the software, the site, the RCM 1 model, and our branding — is owned by the Company or its licensors. These Terms do not transfer any rights in the Service to you beyond the right to use it.
Your footage and your edited output remain yours, as stated in Section 5.
11. Copyright Complaints (DMCA)
If you believe content on the Service infringes your copyright, send a notice to zan@realcut.ai with the subject "Copyright notice", including:
- Identification of the copyrighted work you claim is infringed
- Identification of the material you want removed, with enough detail for us to locate it
- Your name, address, and email
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the notice is accurate and that you are the copyright owner or authorized to act for them
- Your physical or electronic signature
We remove or disable access to material identified in valid notices and terminate the accounts of repeat infringers. If your content was removed and you believe the removal was a mistake, you may send a counter-notice to the same address.
12. Content Storage and Deletion
- Files are stored only as long as needed to provide the Service
- Deleting a project deletes the media in that project from our storage
- Files are deleted within 30 days of account deletion
- You may request earlier deletion at any time
The Service is not a backup or archival product. Keep your own copies of your raw footage and of any cuts you want to preserve.
13. Service Availability
We provide the Service on a best-effort basis and do not guarantee:
- Continuous uptime
- Error-free operation
- Any particular processing time
We may modify, update, or discontinue parts of the Service at any time. If we discontinue the Service entirely, we will give you reasonable notice to download your content.
14. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid us in the 12 months before the claim
Nothing in these Terms excludes liability that cannot be excluded under the law that applies to you, including mandatory consumer protections in your country of residence.
15. Governing Law
These Terms are governed by the law of Slovenia. Disputes are subject to the jurisdiction of the courts of Ljubljana, Slovenia.
If you are a consumer, this choice does not deprive you of protections granted by the mandatory law of the country where you live.
16. Changes to These Terms
We may update these Terms as the Service develops. We will update the effective date at the top of this page and, for material changes, notify you by email or in the app before they take effect.
Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
